This Privacy Policy explains how we collect, use and protect Personal Data within the BeatStore Pro platform, used for creating and managing online beat stores.

Introduction

This Policy applies to Personal Data processed by BeatStore Pro when providing its Services to music producers (“Users”) and to buyers and visitors of stores hosted on BeatStore Pro (“End Customers” or “Data Subjects”).

Whenever we say “BeatStore Pro”, “we”, “us”, or “our”, we refer to the platform provider. When we say “User”, “you”, we refer to the music producer operating a store. When we say “End Customer”, we refer to individuals purchasing beats through a User’s store.

1. Acceptance

1.1. By using BeatStore Pro’s Services, you confirm that you have read, understood, and agreed to all provisions of this Privacy Policy.

1.2. Acceptance may be recorded along with technical metadata such as IP, date, time and device identifiers for compliance purposes.

1.3. If you do not agree with this Policy, you must immediately discontinue the use of the Services.

2. BeatStore Pro’s Role in Data Processing

2.1. BeatStore Pro may operate either as a Data Controller or a Data Processor, according to the Brazilian LGPD, the GDPR, and other privacy regulations, depending on the context.

2.2. BeatStore Pro as Data Processor

2.2.1. When operating a User’s store—processing navigation, purchases, analytics, AI Assistant interactions, checkout—BeatStore Pro acts exclusively as a Data Processor. The User (producer) is the Data Controller.

  • Defining purposes and legal bases
  • Informing End Customers about data processing
  • Obtaining consent when required
  • Responding to Data Subject rights
  • Ensuring compliance with applicable laws

2.2.3. Nothing in this Policy establishes joint controllership between BeatStore Pro and the User.

2.2.4. The User is solely responsible for commercial decisions based on processed data.

2.3. BeatStore Pro as Data Controller

BeatStore Pro acts as a Data Controller when processing Personal Data required for its own operations, including:

  • User registration and account information
  • Subscription billing and Stripe invoicing
  • Authentication and security systems
  • Navigation on institutional sites
  • Support and communication records

3. Collection of Personal Data

3.1. Personal Data may be collected directly from Data Subjects or automatically through technical mechanisms.

3.2. Data is collected through:

  • Access and navigation on BeatStore Pro websites
  • User registration and use of the Platform
  • Browsing and purchases on hosted stores and subdomains
  • AI Sales Assistant interactions (Pro Plan)
  • Digital forms (registration, checkout, support)
  • Support communication and ticketing systems
  • Cookies, logs, tracking pixels and analytics tools
  • Stripe payment processing integrations

4. Types of Data Processed and Legal Bases

4.1. User Data (Music Producers)

a) Identification and Contact

Name, email address, phone number
Legal basis: Contract performance, Legitimate Interest

b) Access and Security Data

Login credentials, encrypted passwords, session logs
Legal basis: Security obligations, Contract performance

c) Payment and Billing Data

Subscription payment data via Stripe, invoices, transaction history

d) Store Configuration

Store name, subdomain, settings, beat metadata

e) Navigation and Platform Usage

IP address, browser type, device info, timestamps
Legal basis: Legitimate Interest, Consent (non-essential cookies)

4.2. End Customer Data (Beat Buyers)

a) Identification and Purchase Data

Name, email address, purchase history, license type
Legal basis: Contract performance (defined by User as Controller)

b) Payment Data

Payment details processed directly by Stripe connected to the User’s account.
BeatStore Pro does not store credit card information.

c) Navigation and Behavior

Pages visited, beats viewed, interaction events, analytics data
Legal basis: Legitimate Interest of User, Consent (cookies)

d) AI Assistant Interactions

Conversation history, messages exchanged with AI Sales Assistant (Pro Plan)
Legal basis: Contract performance, Legitimate Interest of User

AI responses are automated and do not produce solely automated decisions with legal or significant effects.

4.3. Sensitive Data and Minors

4.3.1. BeatStore Pro does not intentionally collect Sensitive Personal Data.

4.3.2. The Platform is not intended for individuals under 16. Users aged 16–18 must have guardian authorization. Any improperly collected data will be deleted.

5. Purposes of Data Processing

Personal Data is processed for the following purposes:

A) Users (Music Producers)

  • Enable creation and management of online beat stores
  • Process subscription billing and payments
  • Provide platform access, authentication, and account security
  • Deliver technical and operational support
  • Send service-related and legal communications
  • Improve platform performance, stability, and features
  • Comply with legal and regulatory obligations
  • Protect BeatStore Pro’s legal rights

B) End Customers (Beat Buyers)

  • Enable beat purchases and file delivery
  • Process payments via Stripe
  • Enable AI Sales Assistant functionality (Pro Plan)
  • Generate analytics and insights for Users
  • Comply with applicable legal obligations

Anonymized data may be used indefinitely for statistical and technological improvement.

6. Data Sharing

6.1. Personal Data may be shared strictly with service providers essential to the operation of the Platform, including:

  • Stripe (payment processing)
  • OpenAI (AI Assistant processing)
  • Analytics tools
  • Cloud hosting and CDN services
  • Email and communication service providers

6.2. All sharing is subject to confidentiality, data protection, and security obligations.

6.3. Personal Data may also be disclosed:

  • To comply with applicable legal obligations or court orders
  • To protect BeatStore Pro’s legitimate rights and interests
  • In corporate transactions (merger, acquisition, asset sale), with prior notice

6.4. BeatStore Pro does not sell Personal Data under any circumstances.

7. International Data Transfers

7.1. Personal Data may be transferred and processed outside Brazil due to the use of international service providers.

7.2. Such transfers are conducted in compliance with LGPD, GDPR, and other applicable laws, using:

  • Adequacy decisions
  • Standard Contractual Clauses (SCCs)
  • Other legally recognized transfer mechanisms

8. Storage and Retention

8.1. Personal Data is stored in secure environments using industry‑standard security practices.

8.2. Data is retained only for the period necessary to fulfill the purposes described in this Policy or to comply with legal requirements.

8.3. Retention periods include:

  • User Data: retained during the active subscription; account data deleted within 7 days after cancellation.
  • Billing and transaction records: retained for legally required periods (generally up to 5 years).
  • Security and fraud prevention logs: may be retained longer when required for dispute resolution or legal defense.
  • End Customer Data: retained while the User’s store is active and deleted along with the User’s account.

8.4. Anonymized data may be retained indefinitely.

9. Data Subject Rights

9.1. Data Subjects may request the exercise of rights guaranteed by LGPD, GDPR and similar regulations, including:

  • Access to Personal Data
  • Correction of inaccurate or incomplete data
  • Deletion of Personal Data when legally applicable
  • Portability of data to another service provider
  • Objection to processing activities
  • Withdrawal of consent where processing is based on consent

Responsibility for Requests

9.2. Users: Requests must be submitted directly to BeatStore Pro.

9.3. End Customers: Requests related to stores hosted on BeatStore Pro must be directed to the respective User (the Data Controller). BeatStore Pro will provide technical assistance when necessary.

10. Information Security

10.1. BeatStore Pro adopts appropriate technical and organizational measures to safeguard Personal Data, including:

  • Encryption and secure transmission of data
  • Strict access control and authentication mechanisms
  • Systems monitoring and activity logging
  • Regular backups and secure storage environments

10.2. No system is entirely secure, and absolute protection cannot be guaranteed.

10.3. If a security incident occurs that may pose risk or harm to Data Subjects, BeatStore Pro will notify the competent authorities and affected individuals when legally required.

11. Cookies and Similar Technologies

11.1. BeatStore Pro uses essential cookies required for the functioning of the Platform, as well as analytics and marketing cookies to improve performance and user experience.

11.2. Where required by applicable law, non‑essential cookies are activated only after explicit consent provided through a cookie banner or consent management mechanism.

11.3. Users and End Customers may manage cookie preferences through:

  • Browser settings
  • The Platform’s own cookie consent tool (when available)

12. Third‑Party Integrations

The Platform integrates with third‑party services that have their own privacy practices and policies, including but not limited to:

  • Stripe (payment processing)
  • OpenAI (AI Assistant interaction processing)
  • Analytics services (e.g., Google Analytics)
  • Cloud hosting, storage and CDN providers

BeatStore Pro is not responsible for the privacy practices of third‑party services, which remain subject to their own policies.

The Data Protection Officer (DPO) is responsible for handling privacy‑related inquiries and requests.

16. General Provisions

This Privacy Policy must be read together with the Terms and Conditions of Use of BeatStore Pro.

Any invalid or unenforceable provision will not affect the remaining provisions, which shall remain fully effective.

The terms used in this Privacy Policy follow the definitions provided by LGPD and GDPR, including:

  • Platform: BeatStore Pro's service environment
  • User: music producer who uses the Platform
  • End Customer: buyer who acquires beats through a User’s store

  • Controller: the party responsible for decisions regarding data processing
  • Processor: the party that processes data on behalf of the Controller
  • AI Assistant: automated assistant powered by AI technology
